Public consultation on a preliminary analysis of wholesale mobile market

In 2018 CTU preformed the so called 3 criteria test on a delineated market of mobile services which comprised voice services, SMS and data services provided via 2G, 3G and 4G networks. For the segment of residential customers, the test proved that this market meets the three criteria and is therefore susceptible to ex-ante regulation. Following the three criteria test CTU has now prepared a preliminary analysis of the mobile market (segment of residential customers) with the aim to evaluate potential existence of undertaking/s with significant market power (SMP) on the defined wholesale market. For the evaluation CTU used the methodology and criteria used for market analyses. Considering the nature of the mobile market, which is an oligopoly market, the evaluated criteria indicate an existence of tacit collusion by the three mobile network operators - O2 Czech Republic a.s., T-Mobile Czech Republic a.s. a Vodafone Czech Republic a.s.  

Even if the preliminary analysis is not being performed in the standard regime of market analyses, CTU now publishes the so far gained results. The aim is to allow all stakeholders to express their views to the preliminary findings. CTU will consider the comment and will publish a settlement of comments. Next steps will also be communicated afterwards.
