Producer or his authorised representative are obliged to make a notification of certain equipment. Conditions of the notification are set in the Section 4 (6) of the government order No. 426/2000 Coll. laying down the technical requirements for radio and telecommunication terminal equipment, as amended:
„(6) In the case of radio equipment using frequency bands whose use is not harmonized throughout the Community, the manufacturer or his authorized representative established within the Community or the person responsible for placing the equipment on the market shall notify the national authority responsible in the relevant Member State for spectrum management of the intention to place such equipment on its national market. This notification shall be given no less than four weeks in advance of the start of placing on the market and shall provide information about the radio characteristics of the equipment (in particular frequency bands, channel spacing, type of modulation and RF-power) and the identification number of the notified body referred to in Annex IV or V.“
These requirements are in accordance with Article 6.4 Directive No.1999/5/ES.
Since the 1 January 2007, in accordance with the position of TCAM (Telecommunication Conformity Assessment and Market Surveillance Committee) the notification of placing the equipment on the market is required in the Czech Republic only for the equipment that is not possible to operate in the Czech Republic on the basis of general authorisations. Following equipment doesn’t come under the obligation of the notification in the Czech Republic:
There is an obligation to make notification for all other equipment. The manufacturer or his authorized representative established within the Community or the person responsible for placing the equipment on the market send the Notification in Czech or English language:
Earlier approved products, or products where the conformity was assessed by the Czech telecommunication office, are considered to be notified on 1 May 2004.
