CALL for comments on draft Measure of General Nature No. A/S1/0x.2022-x, amending Measure of General Nature – market analysis No. A/1/04.2020-3, Market No. 1 – Wholesale call termination on individual public telephone networks provided at a fixed location

The Czech Telecommunications Office (hereinafter as "CTU") has prepared a draft Measure of General Nature No. A/S1/0x.2022-x, amending the Measure of General Nature - market analysis No. A/1/04.2020-3, market No. 1 - Wholesale call termination on individual public telephone networks provided at a fixed location, pursuant to Section 51 and in accordance with Section 51(10) of Act No.127/2005 Coll., on Electronic Communications and on Amendments to Certain Related Acts (Electronic Communications Act), as amended.

The changes to the measure reflect a change in the market where CETIN a.s., as one of the undertakings designated as having a significant market power in the relevant market, has ended providing termination services following a technological change in its network.

In accordance with the procedure referred to in the market analysis No. A/1/04.2020-3, Market No. 1 - wholesale call termination on individual public telephone networks provided at a fixed location, CTU prepared an amendment to the measure in question on the basis of the transfer of provision of wholesale call termination services on individual public telephone networks provided at a fixed location from CETIN a.s. to O2 Czech Republic a.s. The amendment is proposed in the operative part of the measure, specifically in Article 2 and Article 3 of the original Measure of General Nature No. A/1/04.2020-3.

CTU has followed a consistent and predictable approach for undertakings operating networks and providing services in electronic communications and, based on the approach announced in the above mentioned analysis, has proceeded to a partial amendment to the analysis rather than a review of the entire relevant market.

This Measure of General Nature No. A/S1/0x.2022-x is therefore without prejudice to the timing of the analysis of the relevant market - Market No. 1 - wholesale call termination on individual public telephone networks provided at a fixed location, as set out in the analysis of this relevant market issued by Measure of General Nature No. A/1/04.2020-3.

Comments on the draft Measure of General Nature No. A/S1/0x.2022-x could be submitted within 1 month from the date of publication of this call, i.e. by 1 August 2022.
