Competences of CTU

The competences of the CTU are established, in particular, by:

  • Act No. 127/2005 Coll.,
    on Electronic Communications and on Amendment to Certain Related Acts (the Electronic Communications Act), as amended,
  • Act No. 29/2000 Coll.,
    on Postal Services and on Amendment to Certain Related Acts (the Postal Services Act), as amended,
  • Act No. 194/2017 Coll., on measures to reduce the cost of deploying high-speed electronic communications networks and on amendment to certain related acts,
  • Act No. 206/2005 Coll.,
    on the protection of certain broadcasting services and information society services, as amended by Act No. 281/2009 Coll.,
  • Act No. 69/2006 Coll.,
    on carrying out international sanctions, as amended,
  • Act No. 634/1992 Coll.,
    on customer protection, as amended.
  • Act No. 67/2023 Coll.,
    on certain measures against the dissemination of terrorist content online

Competences of the Czech Telecommunication Office under Act No. 127/2005 Coll., on Electronic Communications and on Amendment to Certain Related Acts (the Electronic Communications Act), as amended

  • Under the Electronic Communications Act, the Czech Telecommunication Office in particular:
  • a) issues general authorisations, decides on any change thereto or cancellation thereof, and maintains records of undertakings in the electronic communications,
  • b) issues measures of general nature,
  • c) performs analyses of relevant markets in the electronic communications area, determines undertakings with significant market power and imposes special obligations on them,
  • d) determines the universal service providers in electronic communications and examines how the universal service is provided,
  • e) determines the net costs of the provision of universal service, decides the obligation to return the funds illegally taken out to cover the net costs of the provision of universal service and determines whether the net costs are an unbearable burden for the provider,
  • f) issues the pricing decisions and exercises the price control in the electronic communications area,
  • g) makes the decisions in disputes, as far as the Act so stipulates,
  • h) co-operates with the competent national regulatory authorities of the Member States, the European Network and Information Security Agency (ENISA), the Body of European Regulators for Electronic Communications (BEREC) and with the European Commission,
  • i) imposes the non-financial performace obligations,
  • j) verifies the professional capability for the operation of radio transmission equipment,
  • k) exercises the authority of a recognising body under a special legal regulation in recognising the professional qualifications and other competence for access to regulated activities in the electronic communication area or for the performance of such activities in the Czech Republic, if the professional qualifications for such activities were gained, or such activities were performed outside the Czech Republic by citizens of the Member States of the Communities or their family members,
  • l) specifies, collects and enforces fees,
  • m) carries out the state inspection in the electronic communications area, searches for and removes interference sources,
  • n) imposes, collects and enforces penalties fines for breach of obligations,
  • o) exercises the administration of radio frequencies and numbers, including the maintenance of the database thereof,
  • p) carries out tendering procedures and monitoring compliance with obligations to holders of radio frequencies from tenders,
  • q) ensures harmonisation of the utilisation of the radio spectrum and harmonisation of the numbering plans,
  • r) opens and administers the Radio Communications Account,
  • s) submit to the Ministry the factual draft legal regulations in the electronic communications area and co-operates with the Ministry on the preparation thereof,
  • t) issues implementing legal regulations in the electronic communications area within the range of authorisation under the Act,
  • u) ensures the notification and information obligations in relation to the European Commission in respect of the issues belonging in the Office's range of authority,
  • v) provides the state statistical service,
  • w) pursues international relations in the electronic communications area in cases determined by the Government,
  • x) within its statistical surveying work, collects and processes data in the electronic communications area from entities carrying out communication activities and from natural persons under conditions set out in specific legal regulations, and makes the data so collected available to the Ministry,
  • y) publishes Telekomunikační věstník (the Telecommunications Bulletin) through the public administration portal,
  • z) decides to impose an obligation to amend the contract or its published proposal for a publicly available electronic communications services or to provide access to a public communications network according to Section 63 Subsection 5,
  • aa) is enforceable administrative authority for enforcing the obligations under this Act or the obligations imposed ex officio on the basis of this Act,
  • bb) operates information systems in accordance with this Act and the automated system for frequency spectrum monitoring,  
  • cc) makes available information on the rights granted for the use of radio frequencies and on the use of the radio spectrum,
  • dd) is the authority concerned when assessing the maturity of energy infrastructure projects of common interest and applies a binding opinion in joint planning and construction proceedings for the construction of projects of common interest in terms of its competence,
  • ee) assesses and monitors issues of market formation and competition from the perspective of access to the open internet.

Competences of the Czech Telecommunication Office under Act No. 29/2000 Coll., on Postal Services and on Amendment to Certain Acts (the Postal Services Act), as amended

Under the Postal Services Act, the Czech Telecommunication Office in particular:

  • a) analyzes the general availability of the universal services and examines the need to impose the obligations to provide and ensure the universal services,
  • b) keep a register of operators and grants postal licence to designated operator which has the duty to provide and ensure universal services,
  • c) determines net costs of providing and provision of universal services, decides the obligation to return the funds illegally taken out to cover the net costs and determines whether the net costs for a postal license holder are an unfair financial burden,
  • d) issued a decision on the price of universal services and exercise control prices in the postal services, including postal services abroad, and prices for access to the postal infrastructure,
  • e) makes the decisions in disputes, as far as the Act so stipulates,
  • f) cooperates with the European Union institutions and regulatory authorities of the Member States of the European Union with a similar material scope particularly in the transmission and retrieval of data and information provided by law, the decisions taken on the basis of the law or legal acts of the European Union, and perform other tasks for the regulation of postal services under Czech Republic's membership in the European Union,
  • g) determines, collects and enforces fees,
  • h) carries out the state inspection in the field of postal services,
  • i) performs the state statistical service , including data collection in the field of postal services and foreign postal services,
  • j) imposes, collects and enforces penalties for breach of the obligations set out in this Act,
  • k) issues implementing legal regulations in the field of postal services within the range of authorisation under the Act,
  • l) is enforceable administrative authority for enforcing the obligations under this Act or the obligations imposed ex officio on the basis of this Act,
  • m) determines on change of postal conditions according to Section 6 Subsection 4,
  • n) determines, collects and enforces payment on account for the financing of universal services.  

Competences of the Czech Telecommunication Office under Act No. 194/2017 Coll., on on measures to reduce the costs of deploying high-speed electronic communications networks and on amendments to certain related acts, as amended

Under this Act, the Czech Telecommunication Office in particular:

  • (a) provides a single information point,
  • (b) resolves the disputes, if provided for in this Act,
  • (c) is the administrative enforcement authority for the enforcement of obligations imposed by decisions under this Act,
  • (d) deal with administrative offences.

Competences of the Czech Telecommunication Office under Act No. 206/2005 Coll., on the protection of certain broadcasting services and information society services, as amended by Act No. 281/2009 Coll.

Under this Act, the Czech Telecommunication Office performs, in particular, the following activities:

  • a) discusses administrative offenses and offenses,
  • b) collects and enforces penalties. 

Czech Telecommunication Office shall also perform other activities, if it follows from the provisions of legal regulations mentioned above or from other legal regulations.

Competences of the Czech Telecommunication Office under Act No. 69/2006 Coll., on carrying out international sanctions, as amended

Under this Act, the Czech Telecommunication Office performs, in particular, the following activities:

a) checks in the exercise of its jurisdiction (the area of postal services and electronic communications services ) also performance of obligations under this Act and for deficiencies , in particular violations of obligations under this Act, passes documents to the Ministry of Industry and Trade or to the Ministry of Finance to sanction proceedings,

b) also cooperates with the authorities mentioned in subparagraph a) on the relevant proceedings.  

Competences of the Czech Telecommunication Office under Act No. 634/1992 Coll., on customer protection, as amended

Under this Act, the Czech Telecommunication Office performs, in particular, supervision of compliance with the obligations set out in the Sections 3 to 5, 6, 9, 11-13, 15-16 and 19 in the area of electronic communications and postal services.

Competences of the Czech Telecommunication Office under Act No. 67/2023 Coll., on certain measures against the dissemination of terrorist content online

Under this Act, the Czech Telecommunication Office in particular:

(a) supervise the implementation of the specific measures pursuant to Article 5 of Regulation (EU) 2021/784 of the European Parliament and of the Council of 29 April 2021 on combating the dissemination of terrorist content online, and in the exercise of supervision may carry out inspection in accordance with the Inspection Order,

(b) decide, at the request of the hosting service provider or ex officio, that the hosting service provider is no longer exposed to terrorist content pursuant to Article 5(4) of the aforementioned Regulation, 

c) if necessary to ensure the reliable fulfilment of the hosting service provider's obligations under that Regulation, CTU may order the provider to use the specialised electronic system administered by Europol (the Europol system), if established, for communication pursuant to Article 7(1),

(d) cooperate with the police and the Ministry and exchanges with them information, including personal data necessary for the performance of tasks under the Regulation, with the competent authorities of other Member States of the European Union or States which are contracting parties to the European Economic Area and with Europol, including through the Europol system, if established, 

(e) passes to the European Commission the information referred to in Article 21 of the aforementioned Regulation which has been transmitted to it by the Police, the Ministry and hosting service providers, 

(f) publish the annual reports referred to in Article 8 of that Regulation,

(g) may impose an enforcement fine not exceeding CZK 100,000 on hosting service providers to enforce the obligation imposed on them, 

(h) deal with administrative offences under this Act and collect and enforce fines.
